End User License Agreement (EULA) – Jettify.app

1. Contracting Parties

The service is provided by:

This Agreement applies to all use of the Jettify.app service in Finland. The official language of the Agreement is Finnish.

2. Purpose of Agreement

This Agreement sets forth the terms under which the User may use the Jettify.app service.

The service's primary customer is Jettify's B2B customer (e.g., marina or yacht club) who has entered into a separate service agreement with the Service Provider. The User uses the service within the scope of the rights granted by the B2B customer.

3. Right to Use

1. The User receives a non-exclusive and personal right to use the Service only in accordance with the B2B customer's instructions and the terms of this Agreement.
2. The Service may only be used for lawful purposes and may not be used to distribute content that is harmful, disruptive, or damaging.
3. Resale, copying, reverse engineering, creation of disruption services, or unauthorized automated use (e.g., with bots) of the Service is prohibited.
4. Integrations are implemented only by VGL Innovations Oy or its authorized partner.

4. User Responsibilities

1. The User is responsible for the accuracy and currency of the information they provide.
2. The User is obligated to use the Service in a manner that does not violate laws, good practices, or third-party rights.
3. Misuse of the User's credentials or unauthorized use of the service may result in suspension or removal of usage rights.

5. Service Availability and Limitations

1. The Service is provided "as is" and the Service Provider does not guarantee the Service's continuous error-free operation.
2. The Service Provider is not responsible for disruptions in third-party services (e.g., payment services, internet connections).
3. Liability limitations and possible compensations are defined in the separate service agreement with the B2B customer.

6. Privacy and Data Processing

1. The B2B customer acts as the data controller for personal data collected through the Service. VGL Innovations Oy acts as the data processor according to the B2B customer's instructions.
2. Additional information about personal data processing can be found in the privacy policy.
3. The User may request correction, deletion, or termination of usage rights for their data by contacting the B2B customer directly (e.g., marina or yacht club).

7. Agreement Validity and Termination

1. This Agreement is valid as long as the User uses the Service.
2. The User may terminate the use of the Service at any time by contacting the B2B customer.
3. The Service Provider has the right to close the User's account immediately if the Agreement is materially violated.

8. Applicable Law and Dispute Resolution

1. Finnish law applies to this Agreement.
2. Any disputes that cannot be resolved through negotiation will be handled in the Helsinki District Court.

9. Changes to Agreement

VGL Innovations Oy may update this Agreement as needed. New terms are published in the Jettify.app service and take effect immediately upon publication. By using the Service after changes, the User accepts the new terms.
